chp. >> reporter: good morning. i'm bob redell with commuters' arguments about why it's okay to drive in the hov lanes solo. that story coming up. >> poor, bob. a live look at the fog over san francisco. christina is tracking that forecast on this monday, january 7th. this is "today in the bay." good morning. it's 5:00. san francisco police continue their search for a suspect accused of nothing short of just a brutal and horrendous crime against his girlfriend. police say that he doused her with gasoline and then set her on fire. "today in the bay's" christie smith is live in the city with an update on this story and a search and condition of that victim. christie, good morning.

>> reporter: good morning, jon and marla. the victim in this horrible attack is in the hospital this morning in the burn unit here at st. francis hospital suffering severe burns to her face and chest. san francisco police are asking for the public's help trying to find her boyfriend, the man they believe is responsible, 22 years dexter oliver. witnesses watched in horror yesterday as he threw a flammable liquid on his girlfriend and then set her on fire. those witnesses include her family. family members say the two had been only dating for about six months and they had what they describe as a rocky relationship. they were arguing near a laundromat on hollister near generjennings when lamar told he relationship was over. >> she had to get out and it was over. she left the laundromat. ten minutes later she was burned. >> reporter: now he's accused of returning to the home to get some gasoline and there were

burned clothes in the street after the attack. lamar was seen screaming and running. dexter oliver is 5'10", 155 pounds, distinct haircut. lightning bolt on one side and fish designs on the other. he is facing arson and attempted murder charges. reporting live in san francisco, christie smith, "today in the bay." 5:02. peninsula police are looking for the person who shot a teenage girl right near a local high school. the girl was found saturday night across the street from cappuccino high school in millbrae. the 15 year old is a rare incident of gun violence in a quiet area. this morning she's in stable condition. officers do not know what pro provoked the shooting and have not many any arrests. >> chp releasing the name of a man killed during a crash that shut down interstate 880 for part of the night. the man from san leandro crashed his car into the center divide

near the high street exit in oakland about 7:45 last night. the chp says he then tried to run across four lanes of traffic. he was hit by two cars and died on scene. both drivers did stop and try to help. that crash blocked all lanes northbound 880 for several hours. officers trying to figure out what caused the initial crash. the cause of a crash that killed a woman in san jose remains a mystery this morning. police say the woman sped through a red light to make it to the highway 85 onramp but she missed the sharp turn and crashed into a pond just off the road. emergency crews had to call in a dive team to pull that woman from the car. she died at the hospital. police are still investigating the cause of that crash. this morning san francisco police hoping to stir up some brand new leads in an unsolved murder case now five years old. we have sketches of two suspects

accused of killing a man on january 7th, 2007. police say the man confronted him at a club and then shotç h in his suv near 13th street in san francisco. he later died at the hospital. today his mother and san francisco police returning to that scene of the crime to discuss the status of this investigation. this morning palo alto police say a suspected package thief may be linked to a crime spree in the south bay. officers have found evidence possibly links andrew phillip stafford to several other thefts in san jose. officers say they found packages stashed away at a storage locker under stafford's name. the 25 year old was arrested back on new year's day in palo alto after a neighbor allegedly spotted him stealing packages. memorial services being held this morning for the south bay's longest serving judge. santa clara county judge paul

our general understanding of the rules of the road are such that if you want to drive in a carpool lane, you must have at least one living, breathing passenger with you to use this lane. a marin man says that's not so and today he'll argue his court case before a judge in marin county traffic court. he'll be in court at 3:00 this afternoon. he said he received a ticket after driving solo in the hov lane without another person in the car. he's going to argue that he in fact wasn't alone that he had his corporation papers with him and since legally corporations are considered people, he believes that he did in fact have another person in the car and did not viet the carpool law. >> he yelled at me. you need two persons in the car.

referencing. it's a light week for economic data with reports on consumer credit, the trade deficit and import prices. earning season kicks off tomorrow night when aluminum giant alcoa reports results. dow rising 43 points on friday to close at 13,435. nasdaq up one closing at 3101. regulators may announce a $10 billion settlement with several major banks. "the new york times" first reported the deal last week says 14 banks including citigroup, jpmorgan, bank of america are all involved. nearly 4 billion will go to people who lost their homes in 2009 and 2010. the rest will be for those currently in the foreclosure process. a look at early business headlines. back over to you guys. >> all right. hampton pearson, thank you much. 5:15. over the weekend we learned of the death of michael cronan. he made up names like tivo and kindle. he lived in berkeley.

rosa. across the board we'll drop off throughout the morning we'll go to future cast. mostly cloudy conditions across the greater bay area when the fog will be at its thickest. between 7:00 and 11:00, we get clearing. a weak disturbance will pass to the north driving in high mid level clouds later on today. it's going to kick up our winds and that will keep fog from settling in. tomorrow morning same deal. look at these numbers. look at where we're headed. ten-degree jump from yesterday. 61 in san jose. 61 degrees today in beautiful las vegas. 62 for gilroy. looking good. we're go to hold onto sunshine through tuesday and then clouds thicken up and temperatures drop off wednesday into thursday. into the weekend, temperatures stay cool. next round of rain on the way for sunday. tahoe is about 140% above average in terms of snow pack right now. we'll take a look at how the ski resorts are faring.

let's find out how your drive is faring with mike inouye. >> we'll look out here to roadways. we talk about this. westbound push. that's your commute direction for 580. orange highlighted. we talked about this integration from traffic and weather maps. likely fog. christina says her readings are the same. quarter mile visibility for 580 and slowing coming out of altamont pass. slow through livermore and pleasanton. traffic smooth 680 southbound into the south bay. here the san mateo bridge not a problem. we'll talk about that in a second. the dumbarton bridge fog advisory issued by chp likely over toward the newark area as you come over the water those things might start to clear up. one earlier issue northbound 101 at middlefield. old middlefield way an accident. sounds like activity on the shoulder but lanes are clear northbound. southbound slowing just ticking in around 60. no incidents. we'll keep track of the yellow through this portion.

live look here coming off the peninsula and pushing over toward the westbound commute. we end with the next shot here through emeryville as we see a smooth flow of traffic. no drama. a lot of company. we'll see slowing starting in today. back to you. >> thank you, mike. new this morning, the five men accused of gang raping a woman on a bus in india have made their first court appearance. two of the accused agreed to testify against the other men in order to escape the death penalty. police say a 23-year-old woman was brutally gang raped on a moving bus last month. she later died in the hospital. the horrific act sparked protests across india and calls to do more to protect women from sexual violence. later on today a judge in los angeles deciding whether to release the names of catholic church officials involved in a massive priest sex abuse scan l scandal. the archdiocese of l.a. says it will release thousands of pages of confidential documents with church officials names blacked out on them but media outlets

argue that blacking out names is unnecessary and it's overboard. the files are expected to be released any day now. more than five years after the church reached a $660 million settlement with more than 550 plaintiffs. the shell oil drilling ship that ran aground near alaska is now upright and stable. late last night it was floated from the rocks where it ran aground. shell is now checking the ship to make sure that it is seaworthy. if it is, shell says it will wait until the weather is good to tow it to a safer place near kodiak. the vessel ran aground on new year's eve. it is it carrying 130,000 gallons of diesel and 12,000 gallons of other fluids. the time is 5:20. coming up, moving day. moving into the new digs on the embarcade embarcadero. we'll let you know what the city is doing with the old spot. here you go little man.

good monday morning. a live look over washington d.c. the nation's capital. president obama will be busy with nominations he's putting into motion. nominating chuck hagel as secretary of state and nominating john brennan for director of cia. tracie potts will be reporting for us live out of washington in about 15 minutes from right now. san jose's newest city council member starts his first day on the job this morning. the first arab american to serve on the san jose city council. he was sworn in yesterday as the district ten representative which includes parts of south san jose. he says he will focus on rebuilding the city's services and making san jose more business friendly. he was raised in san jose and he graduated from san jose state. 5:23.

moving day for san francisco's exploratorium. crews will begin moving 450 exhibits from the palace of fine arts to the museum's new home at pier 15. the new facility is three times larger than its current location. work should be done in a few weeks. a grand opening will be held later this april. with the exploratorium soon gone, the old home at the palace of fine arts is on the market. the building has 80,000 square feet of space and asking price starts at $490,000 a year. city officials say a search for a long-term tenant could take a year or two. >> that exploratorium looks fun. i have never done it. once it does move i suggest we do a field trip and head over. christina loren, are you in with us? >> i'm so in. i was there yesterday. good morning to you. yesterday we had the rain showers coming through. kind of a dreary start to the day. that sun came out in full force

by the finish of the day and yesterday ended up nice. temperatures today will climb by ten degrees. we hit 52 degrees inland yesterday. 62 today. 61 bayside. at the coast you'll hit 60 degrees. a mix of sun and clouds. we do have some thick fog to get through before that sun comes out. keep that in mind. travel cautiously. let's check on that drive. how about right now? good morning, mike. >> we do have thick fog. one of the usual suspects golden gate bridge not the case. early morning hours we don't see that fog. it drifts in as the heating happens. we might see that later on. right now a smooth drive between the north bay and the city. look at that. lanes are ready for the morning commute. i saw them move the cones. smooth drive into the city off the bay bridge. the overnight construction crew has cleared and no problems across that span. the east shore freeway at the limit and so is the area highway 24 out of the caldecott coming over toward the maze but we're watching this morning for the return of the commute as most people's vacations are over. we'll see how it shapes up over

the next 25 minutes. back to you. 5:25. here's something you don't see every day. police at australia's melbourne airport responding to an unusual call. the cops having a tough time getting the kangaroo. giving them the slip outside into the parking lot there when the officers would get close, he just kept hopping away. you can see the kangaroo licking his arm which is a sign of distress. that zookeeper got called in and they tranquilized the animal after a long chase and the kangaroo will be kept under observation until it is deemed ready to return to the wild. they are fast. they get up around 40 miles an hour. >> very fast. looking for a parking spot. >> cute guy. >> he's got serious calves on him. still to come on "today in the bay," some bay area communities getting a chance to voice their anger over plans to close local fire departments. right now we take you back outside. a live look over san jose. the sun is not quite up yet.

a live look outside at san jose getting your day one of the workweek started off with a nice glowing look on this monday, january 7th. this is "today in the bay." a very good morning to you. thank you for joining us. 5:30 on the nose. i'm jon kelley. >> i'm marla tellez pch. laura garcia-cannon is off today. a manhunt is on for a san francisco man accused of setting his girlfriend on fire after the two got into a fight. "today in the bay's" christie smith is live outside of st. francis hospital where the young woman is being treated for life threatening burns. christie, good morning. >> reporter: good morning to you, marla. this story is just awful. it doesn't get much worse than this. a woman doused in gasoline and set on fire over the weekend. she is in the hospital this morning here at st. francis in the burn unit with severe burns to her face and her chest. now san francisco police are

asking for the public's help. they are trying to find this woman's boyfriend. they say he's the main suspect and he's been identified as 22 year old dexter oliver. witnesses watched in horror yesterday as they say he threw a flammable liquid on his girlfriend 25-year-old star lamar and set her on fire. those witnesses actually include her family members. they say that the pair had been dating for about six months and had quite a rocky relationship. they say the couple was arguing by laundromat in the bay view district and she told him it was over and she had to get out and that's when he went to their home to get some gas. >> i didn't think it would go this far. couples argue all the time. i didn't know it was going to go this far. >> reporter: lamar then ran screaming toward her home for at least a block. there were burned clothes left in the street. that suspect, dexter oliver,

5'10", 1 a55 pounds. he is facing attempted murder charges. if you know anything about his whereabouts, give san francisco police a call. reporting live in san francisco, christie smith, "today in the bay." this morning san jose police hoping new clues will help lead them to suspects in the city's first homicide of the year. officers found the body of a man in front of a home on tripoli avenue yesterday morning. that's just a few blocks from mclaughlin avenue. officers say that man was shot in the head but they did not have a motive for that shooting. he was in his 30s and related to the people inside of the house where he was found. there were 46 homicides in san jose last year. that is more than any year since the 1990s. the man accused of killing seven people in a shooting rampage at a oakland university is expected in court this afternoon. lawyers will hear from a court ordered psychologist on whether

go is competent to stand trial. in november another psychologist said go suffers from paranoid schizophrenia and could not understand charges against him. go is facing murder and attempted murder charges for the shootings last april. turns out oakland's police are not happy with the city's plans to help out the departnt. the chronicle reports the police union is upset about the city's plan to bring in ten alameda county sheriff's deputies and sergeants to help out the understaffed department. officers think the $530,000 could be better spent on squad cars, better training or new hires. a special meeting being held tonight to talk about proposed closure of several east bay firestations. county supervisors voted last month to shut down four stations in clayton, lafayette, martinez and walnut creek. they say the closures are

but you have less than a quarter mile in parts of the east bay. that goes for livermore. travel cautiously out there this morning. napa is also dropping off to a half mile. three-quarter mile reported for now in santa rosa. we expect numbers to continuously fall like temperatures. as we head through the next few hours. 41 degrees in san francisco. 34 to start in napa. 41 degrees in gilroy. cold enough for patchy frost. you might find that on your windshield this morning. throughout the afternoon, 62 degrees at 4:00 p.m. inland. 60 comfortable degrees today. you can sit out there on the sand by the beach and have a beautiful day not too cold out there. 5:35. a lot of people -- i noticed that on my drive to work this morning. >> good morning to you. you'll notice more folks in my traffic shot. even starting right now. look at this. west 80 with the headlights coming through berkeley and emeryville underneath university avenue over crossing. a start to the commute coming back after the school vacations

"today in the bay's" bob redell is live in san jose right now and, bob, i guess the outcome could mean some big-time changes for all california drivers,

right? >> reporter: that's what this person is hoping. right now for me and my driver to be in the carpool lane on northbound 880 in san jose, i have to be a passenger. he has to have a passenger in the car, right? not so according to jonathan friedm friedman, an activist in the north bay who received a carpool violation ticket this past october. today he'll argue before a marin county traffic judge that he did in fact have another person in the car. even though he was "driving solo." his argument is that when he was pulled over, he was carrying his corporation papers with him and since legally corporations are considered people, he believes that he did in fact have another person in the car and did not violate the carpool law. we spoke to a legal person about this. legal expert. they said, sure, maybe you can present that argument but does

welcome back. today president obama is expected to nominate former republican senator chuck hagel as defense secretary but opposition is growing in the senate, most of it coming from hagel's gop colleagues. tracie potts is live on capitol hill where a new announcement came out a few hours ago. >> reporter: early this morning. good morning, everyone. john brennan, the president's top adviser on counterterrorism is now going to be nominated to head the cia. not a strange position for him. he's been at the agency for 25 years. he was actually considered for that job once before when the president first took office in 2008. but brennan withdrew his name from consideration after criticism about his work under the bush administration and whether he had backed

controversial interrogation techniques. he denies that he did and that could come up again as he's now renominated or nominated i should say and awaits confirmation hearings. meantime, you mentioned the defense secretary nominee that the president will also announce today. chuck hagel won a purple heart in vietnam. a moderate republican that some of his colleagues say has made the wrong call on tough issues like iran, not backing unilateral sanctions by the u.s. or israel suggesting they should work with enemies diplomatically calling pro-israel groups the lobby. president obama says he's the pick. no word on when either of those confirmation processes are scheduled. >> okay, tracie, thanks so much. also on capitol hill, secretary of state hillary clinton all set to return to work today following a rough month dealing with medical

problems. clinton contracted a stomach virus earlier last month. she reportedly became dehydrated and then fainted hitting her head causing a concussion. during a follow-up exam, doctors found a blood clot and then admitted her to the hospital. she was released this past wednesday. clinton is now planning to leave office when a successor is approved by congress. the president has already nominated john kerry for that job. later this morning we'll learn more about the suspect in the colorado movie theater massacre. the preliminary hearing gets under way today against james holmes accused of killing 12 people at that movie theater in aurora last july. during the preliminary hearing, the judge will listen to 911 calls and watch video clips and hear from various witnesses. the hearing will determine if there's enough evidence to try holmes for murder. an east bay lawmaker introducing a controversial piece of legislation in hopes of

curbing gun violence. nancy skinner announcing plans today to file a bill that would tighten regulations on ammunition sales in the state. the bill is in response to the school shooting in newtown, connecticut, where the gunman was found carrying high capacity magazines. the bill would ban such magazines from being sold here in california. oakland mayor general kwan and several oakland city council members will attend today's announcement. help is on the way for victims of superstorm sandy. the president signing into law an almost $10 billion bill to pay for flood insurance claims. the law increases fema's borrowing authority. the white house says without the additional money, more than 100,000 flood claim payments from sandy would be delayed. congress plans to vote on a comprehensive sandy aid package on january 15th. it is 5:44 right now for your comprehensive look at the weather who better to do it than christina loren. today we're talking sunshine on the way. a full dose.

progressing through tuesday, same deal. low clouds and drizzle to start. we'll clear out and see sunshine in the afternoon. things start to get a little bit cool as we head through wednesday. area of low pressure will move into northern california and this is going to usher in cooler air for the bay area keeping that onshore flow firmly in place. that cool ocean breeze and clouds coming off the pacific for your wednesday. temperatures are going to drop like a rock. and then possibly just maybe getting some very light showers in the afternoon hours of wednesday. we're not calling it anything significant just yet. i think maybe a trace amount of rain. nothing measurable. so this is what we're talking about when it comes to sierra. how do you like 12 feet of powder? sound pretty good, right? sugar bowl has 12 feet plus. fresh packed powder. squaw, you are up to nine feet. basically we are running 140% above normal. we're looking good on the slopes. more rain on the way throughout this weekend. keep that in mind as well. that's going to translate to snow up there.

back in the '80s, entry into burning man was free. there's something new on the menu at schools in san francisco this morning. the school district is partnering with bay area based revolutions foods to offer healthier options for kids. it was started by two uc berkeley students using local ingredients to make homemade lunches. >> on the ice, it's a done deal. we could find out today when sharks will play the first game of the season and the first game of the year over at hp pavilion. they will release the schedule as early as this morning. terms of the deal need to be ratified by both sides. league executives say they would like a 48-game regular season schedule and it could start as early as january 19th. comcast sports net tells us why
